Terms & Conditions
1. Introduction
These Terms and Conditions ("Agreement") govern your access to and use of the services provided by Swan Tutoring ("we", "us", "our"), including online lessons, course materials, and participation in any associated online platforms (the "Services").
By creating an account, booking a lesson, submitting payment, or participating in Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Services.
2. Lessons and Scheduling

Lessons are delivered online via Zoom

The academic year consists of a full 12-month cycle, divided into individual school terms (typically Autumn, Spring, and Summer).

Term schedules, including start dates, end dates, holidays, and any known teacher absences, will be communicated at the start of each term.

Should a teacher be unable to conduct a live lesson, a recording or appropriate alternative will be provided.

We reserve the right to amend lesson schedules when necessary due to unforeseen circumstances, providing reasonable notice where possible.
3. Contract Duration and Termination
Enrolment is based on a 13-week block commitment.
Payments are made monthly, with the total cost of each 13-week block divided equally over four monthly instalments.
Parents/guardians may end the contract at the end of a 13-week block, provided written notice is received before the first payment of the next block is processed.
Notice must be submitted via email or through the official Contact Us form on the Swan Tutoring website.
Failure to provide the required notice will result in the automatic renewal of the contract for the next 13-week block, with full block fees remaining payable.
If a student is withdrawn partway through a 13-week block, Swan Tutoring reserves the right to pursue the balance of the full block fees.
4. Payment Terms
4.1 Course Structure and Fees
Tuition is organised into rolling 13-week blocks. Each block is spread over four monthly payments of £26, as shown on the pricing plan screen.
Lessons do not take place during half-terms or school holidays unless otherwise specified; monthly payments remain consistent regardless of the number of lessons in a given month.
4.2 Monthly Payment Terms
Monthly payments are due in advance and provide continuous access to all scheduled lessons within the current 13-week block.
This is not a pay-as-you-go system — payments maintain your child’s place across the full block.
If a student misses a lesson, it remains payable; a recording or suitable make-up resource may be provided. If a lesson is cancelled by the teacher, an alternative session or recording will be offered at no additional cost.
Failure to maintain regular payments may result in suspension of services until the account is brought up to date.
4.3 Contractual Commitment
By enrolling, you enter into a contractual agreement for a 13-week block.
Monthly payments contribute toward the cost of that block, regardless of attendance. Once a block has started, the contract becomes active and cannot be cancelled or refunded mid-block.
If you choose not to continue into the next block, you must provide written notice before the first payment of the new block is processed (see Section 3).
These terms ensure consistent lesson delivery and fair working conditions for our tutors.
4.4 Cancellation Policy
To cancel enrolment for an upcoming 13-week block, written notice must be received before the first payment of the new block is processed.
If a student is withdrawn partway through a 13-week block, payments made to date will be applied toward the cost of that block, and any remaining balance will remain payable.
Overpayments are non-refundable.
These policies ensure smooth scheduling and fair payment arrangements for all families and tutors.
5. Curriculum and Materials

Course content may include live instruction, digital worksheets, quizzes, and other supporting materials.

Swan Tutoring provides materials for personal, non-commercial educational use only.

Some worksheets may require printing by the parent/guardian at their own expense.

All materials remain the intellectual property of Swan Tutoring or its licensors.
6. Student and Parent/Guardian Responsibilities
Parents/guardians are responsible for ensuring that:

The student attends all scheduled lessons promptly and consistently.

The student engages fully with lesson content and completes any recommended activities.
-
A responsible adult (parent/guardian) supervises the student during lessons, particularly for minors.

Behaviour during lessons is respectful and appropriate.

Any background noise, distractions, or inappropriate activity on video/audio feeds are the responsibility of the parent/guardian.

Swan Tutoring is not responsible for inappropriate behaviour, language, or material originating from the student's location.

Parents/guardians must promptly notify Swan Tutoring of any issues, concerns, or anticipated absences.
7. Behaviour and Conduct

Respectful behaviour is mandatory from students, parents/guardians, and anyone present during lessons.

We reserve the right to remove or block access to any participant engaging in disruptive, inappropriate, or abusive behaviour.

No refunds will be issued if access is removed due to misconduct.

Swan Tutoring is not liable for any behaviour or conduct of students, parents, or guardians during lessons or use of associated platforms.
8. Online Community (Future Development)

Swan Tutoring may, in the future, offer an online group platform for collaboration between students and teachers.

This platform will be accessible only to currently enrolled students and will be moderated by Swan Tutoring staff.

Community participation is subject to separate Community Guidelines, which will be issued prior to launch.

Swan Tutoring reserves the right to suspend or remove users from the platform for breaching guidelines.
-
Swan Tutoring is not responsible for user-generated content but will moderate the space to the best of its ability.
9. Teacher Responsibilities
Teachers are responsible for:

Delivering high-quality, punctual, and prepared lessons.

Providing reasonable support and feedback.
-
Communicating clearly with parents/guardians regarding progress or concerns.

While Swan Tutoring exercises reasonable care in selecting and assigning teachers, we disclaim all liability for any independent actions, negligence, or misconduct by teachers beyond their assigned teaching duties.
10. Limitation of Liability
To the maximum extent permitted by law, Swan Tutoring shall not be liable for:

Any indirect, incidental, consequential, or punitive damages.

Any internet, hardware, software, or connectivity issues affecting lesson access.

Any misconduct or inappropriate behaviour by students, parents, or guardians.

Any damages resulting from the misuse of lesson materials or the online platform.

In any case, Swan Tutoring’s total liability for any claim shall not exceed the total amount paid for the term during which the claim arises.
11. Intellectual Property

All content, materials, logos, and lesson resources provided by Swan Tutoring are protected by intellectual property laws.

You may not copy, distribute, modify, or create derivative works from our materials without prior written consent.
12. Force Majeure
Swan Tutoring shall not be liable for any delay or failure in performing any obligation under this Agreement if the delay or failure is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, governmental action, or major technical failures.
13. Changes to Terms
Swan Tutoring reserves the right to amend these Terms at any time.
Notice of material changes will be provided through your account dashboard or by email.
Continued use of the Services after changes have been posted constitutes acceptance of the revised Terms.
14. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
